NEW DELHI: The election of Dr Dibyendu Mazumdar, president of the Dental Council of India, to the council has been "withdrawn" and "cancelled" by Nilamber-Pitamber University (NPU), which he represented on the council. With his council membership itself being terminated by the university, his appointment as president too is untenable, pointed out those who had filed cases challenging the legality of his appointment in the Delhi high court and the Kerala high court.
According to a memo issued by NPU registrar on September 1, the appointment of Mazumdar as a visiting professor of Vananchal Dental College and Hospital (VDCH) in Garhwa, Jharkhand, which is affiliated to NPU, and his subsequent election to DCI was made "in gross violation of relevant statutory provisions as contained in the Jharkhand State Universities Act 2000 and the Dentist Act, 1948".
On receiving a copy of the petition filed in the Kerala HC challenging his appointment to the college, the university re-examined the issue and discovered irregularities in his appointment and subsequent election to DCI, the memo said. The university issued a show cause notice to Mazumdar on June 22 asking why his appointment should not be cancelled and his subsequent election to DCI annul led. After examining his response, the university decided to reject it saying he had not addressed the issues raised.
The university terminated his appointment as visiting faculty at the Vananchal Dental College and also withdrew and cancelled his election "from the non-existing faculty of dentistry in NPU". The university order was to come into force with immediate effect.
The university authorities say they have informed the union health ministry and DCI, but neither appears to have acted on it. The DCI website still shows Mazumdar as the president.Earlier this year, responding to queries from the ministry on the eligibility of Mazumdar's membership in DCI, the West Bengal government, of which Mazumdar is an employee, wrote that he had not obtained permission from the state government before accepting an honorary teaching designation in NPU.
